Sospesa ingiunzione di pagamento AGEA da quasi un milione di euro

Nell’ormai lontano 2009, alcune aziende agricole del palermitano intendevano costituire un’associazione temporanea di scopo al fine di realizzare un progetto imprenditoriale da un milione di euro, da finanziarsi coi fondi della MISURA 124 del PSR SICILIA 2007-2013.
Tuttavia, prima dell’approvazione della domanda di finanziamento nonché prima della concessione del finanziamento, il sig. T.R. (all’epoca di anni 80), di Campofelice di Roccella, uno dei soci della costituenda associazione, comunicava al consorzio mandatario l’intendo di rinunziare a partecipare alla realizzazione del progetto.
Nelle more, l’associazione sostituiva il socio rinunciante e proseguiva nell’intento di realizzare l’ambizioso progetto da 1 milione di euro.
Sennonché, l’Agenzia per le erogazioni in Agricoltura (AGEA) dopo alcuni anni provvedeva a revocare il finanziamento all’associazione ed a richiedere la restituzione delle somme erogate.
Tuttavia, l’AGEA ingiungeva la restituzione delle somme anche agli eredi del sig. T.R., nel frattempo deceduto. Cosicché, gli eredi del sig. T.R., di Campofelice di Roccella, si rivolgevano agli avvocati Girolamo Rubino ed Alessio Costa al fine di impugnare l’ingiunzione di pagamento emessa dall’Agenzia per le erogazioni in agricoltura.
In particolare, gli avvocati Rubino e Costa, citando in giudizio l’agenzia innanzi il Tribunale di Roma, dimostravano l’estraneità del sig. T.R. dall’associazione temporanea di scopo e per l’effetto dei suoi eredi. Con ciò gli avvocati Rubino e Costa chiedevano al Tribunale di Roma di dichiarare l’illegittimità dell’ingiunzione di pagamento emessa dall’Agenzia per le erogazioni in agricoltura e ciò in quanto gli eredi di T.R. non sono titolari – iure hereditatis e/o iure proprio – di alcuna obbligazione restitutoria nei confronti di AGEA.
Il Tribunale di Roma, con provvedimento del 12.07.2024, ha accolto le difese formulate dagli avvocati Girolamo Rubino e Alessio Costa ed ha sospeso l’efficacia esecutiva dell’ingiunzione di pagamento emessa da AGEA.
Pertanto, nelle more del giudizio nulla dovranno all’AGEA gli eredi del sig. T.R. titolare all’epoca dell’omonima azienda agricola.
