“Ha ucciso senza intenzione e provocato”: 8 anni e 8 mesi di carcere

Rissa tra due a Balestrate: uno muore. L’altro è stato condannato anche in Appello a 8 anni e 8 mesi di carcere per omicidio preterintenzionale con l’attenuante della provocazione.

L’11 agosto del 2022, a Balestrate, in provincia di Palermo, un colpo inferto con un oggetto da taglio ad una gamba durante una rissa ha provocato la morte di un giovane di 22 anni, Vincenzo Trovato, nato negli Stati Uniti e residente a Trappeto. Nottetempo, intorno alle ore 3, il ragazzo è stato condotto d’urgenza alla Guardia medica, dove è deceduto a causa della grave ferita alla gamba allorchè la coltellata gli avrebbe reciso l’arteria femorale determinandone la morte per dissanguamento. La rissa sarebbe insorta sul lungomare Felice D’Anna a Balestrate. A telefonare ai Carabinieri sono stati i medici in servizio alla Guardia Medica. Il 15 agosto i Carabinieri della Compagnia di Partinico hanno arrestato Gianvito Italiano, 31 anni, residente a San Donato Milanese ma originario di Castelvetrano, in provincia di Trapani. Gianvito Italiano sarebbe stato indicato dalle dichiarazioni dei presenti in viale Felice D’Anna, alcuni dei quali amici della vittima, come l’autore della ferita alla gamba che avrebbe tranciato di netto l’arteria femorale di Vincenzo Trovato, provocandone la morte. Secondo quanto accertato dai Carabinieri, il delitto sarebbe maturato per futili motivi, forse per una spinta, per uno sguardo o una parola di troppo. Dopo una violenta discussione tra i due, corredata da spintoni e pugni, Gianvito Italiano si sarebbe allontanato e poi è tornato armato con un coltello oppure di un pezzo di vetro di una bottiglia rotta, che non è stato trovato. L’11 gennaio scorso la Corte d’Assise di Palermo ha condannato Gianvito Italiano a 10 anni di carcere, addebitandogli non l’omicidio volontario, come preteso dalla Procura, ma l’omicidio preterintenzionale, con l’attenuante della provocazione. Adesso, in secondo grado di giudizio, la Corte d’Assise d’Appello, presieduta da Angelo Pellino, ha ridotto la condanna dell’imputato, attualmente ristretto ai domiciliari, da 10 a 8 anni e 8 mesi di reclusione.
